EU Settlement Scheme Route

In response to a post-Brexit United Kingdom, this scheme enables EU, EEA, Swiss citizens, and their families, who were residents in the UK before the transition period’s conclusion, to secure their right of residence post-Brexit. Although the deadline was originally on 30 June 2021, late applications are still being accepted.

Family members of EU, EEA, or Swiss citizens can apply for Pre-Settled or Settled Status, provided the relevant EU, EEA, or Swiss citizen already holds a status under the scheme and the family relationship existed before 31 December 2020 (except for a child born or adopted after that date).

What is Pre-Settled Status ?

Pre-Settled Status is applicable to those eligible for status under the scheme but haven’t lived in the UK for a continuous qualifying period of five years, thus not qualifying for Settled Status.

Who can apply for Pre-Settled Status?

Citizens of the EU, EEA, and Switzerland, along with their families who were living in the UK prior to December 31, 2020, are eligible to apply for Pre-Settled Status. Certain family members, such as spouses or civil partners, children, dependent parents, dependent grandparents, or durable partners of EU, EEA, and Swiss nationals residing in the UK before the mentioned date, may also apply for Pre-Settled Status from outside the UK. Both individuals inside and outside the UK have the opportunity to apply, including those who are currently visiting the UK.

Extending Pre-Settled Status

You may apply to extend if absent from the UK for an ‘important reason’ and lacking sufficient time to qualify for Settled Status. In other cases, you may need to apply under another immigration category after Pre-Settled Status expires.

Applying for British Citizenship 

Eligibility to apply for British citizenship arises 12 months after obtaining Settled Status. In some cases, immediate eligibility may apply, such as being married to a British citizen or having evidence of acquiring Permanent Residency status under the EEA Regulations, with at least 12 months passed since that date.
